This Privacy Policy describes how your personal information is collected, used, and shared when you use Actoria — the AI video generation and editing service available at https://actoria.ai and its related applications (the "Service"), operated by OnlyAi Limited, a company incorporated in Hong Kong (Company No. 77930018), with its registered office at Room 5003, 5/F, Yau Lee Centre, 45 Hoi Yuen Road, Kwun Tong, Hong Kong ("we", "us", "our").

By using the Service, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Service.

1. Information We Collect

Personal Information you provide:

• Registration details, including your email address and date of birth (used for age verification).
• Optional profile information, such as a username.
• Images, photos, audio, and video you upload as source material for a generation (an "Actor").
• Generation results (the videos and images the Service produces for you).
• Records of your credit, token, and payment transactions.
• Communications you send us, including support requests and abuse or takedown reports.

Actor / likeness data: An "Actor" is any human likeness used to produce a video — this may be you, a licensed AI actor provided by the Service, or another real person whose appearance you have the right to use. Uploaded photos and videos may contain biometric characteristics (such as facial features, body shape, or voice). We process this material to generate the content you request and to verify appearance and rights, as described in Sections 3 and 4.

Technical Data:

• Device information, operating system and app version, and hardware identifiers.
• IP address and approximate (city/country-level) location, used for language, routing, and fraud prevention.
• Usage analytics, such as session duration, features used, and performance and crash logs.
• Precise location only where you give explicit consent.

2. How We Use Your Data

We use the information we collect to:

• operate, maintain, and provide the Service, including generating the videos and images you request;
• verify that you are 18 or older and screen uploaded material for prohibited content (see Section 5);
• verify appearance and likeness rights, including through the friend-confirmation flow described in Section 4;
• process payments, credits, and tokens, and send you related billing and account notices;
• detect, prevent, and investigate fraud, abuse, non-consensual likeness misuse, and other violations of our Terms of Use;
• respond to your support requests and to abuse and takedown reports;
• analyze usage to improve quality, stability, and safety;
• comply with our legal obligations and enforce our agreements.

We do not use your uploaded images, source material, or generation results to train our own or third parties' AI models, except where such material has been fully anonymized and cannot be linked back to you or to any identifiable person.

3. Biometric and Likeness Processing

Because the Service generates video of real people, uploaded photos and videos may contain biometric information.

• We process biometric characteristics only to (a) generate the content you request, (b) estimate age and screen for prohibited content, and (c) confirm likeness rights when appearance is confirmed or when a complaint is made.
• We do not use biometric data to identify you for advertising or to build identity profiles.
• You may request deletion of your biometric source material and generation results at any time by contacting us (see Section 15), subject to legally required retention.

4. Appearance Confirmation and Friend Confirmation

The Service allows you to generate video featuring a real person only where that person's appearance has been confirmed and the necessary rights are in place.

Appearance confirmation. Appearance verification and video generation are performed through our processor BytePlus (using the Seedance model). Source material is transmitted to BytePlus solely to generate and verify the requested content, under contractual terms that restrict its use for any other purpose, including model training.

Frame (image) generation for confirmed persons. Where a person's appearance has been confirmed, still-frame generation and editing may additionally be performed through our AI processors Alibaba Cloud (Qwen-Image), Google (Gemini), Mistral and fal.ai (hosting Google's Gemini Image / Nano Banana). In that case the character reference image and the scene description are transmitted to these processors solely to generate the requested frame, under contractual terms that restrict their use for any other purpose, including model training. Unconfirmed real-person photos are never transmitted to these processors.

Friend confirmation by link. You may ask another person (for example, a friend) to confirm their own appearance by sending them a confirmation link generated by the Service. When that person opens the link and confirms, they consent to the use of their likeness within the Service on the terms presented to them at that time.

Your responsibility. If you invite another person to confirm their appearance, or you add rights to use another person's face or likeness into the Service, you are responsible for that request. You must understand and accept to whom, and for what purpose, the likeness and associated data are transmitted, and you are solely responsible for having a lawful basis and the necessary consent. We act as a processor of that material for the purpose of operating the Service and are not responsible for your decision to submit or invite it. 5. Content Moderation and Zero Tolerance for Child Content

Uploaded images and generated results are subject to automated moderation, including age estimation and prohibited-content screening performed through Amazon Rekognition (AWS). Images are transmitted to AWS solely for verification and are not used by Amazon to train its models.

The Service strictly prohibits any content involving minors. You may not upload photos of minors, and you may not create, request, or attempt to generate any image or video that depicts, sexualizes, or otherwise involves a minor or a person made to appear as a minor, in any context. This mechanism is enforced automatically and through manual review.

Accounts that upload prohibited child content or attempt to generate it will be immediately suspended and permanently deleted, and material that appears to constitute child sexual abuse or exploitation will be reported to the relevant authorities.

6. Cookies and Tracking

We use cookies and similar technologies for login, session stability, crash diagnostics, analytics, and personalization. You may disable cookies through your browser or device settings, although some features may then not work correctly.

7. How We Share Information

We do not sell your personal data. We share information only with:

• Processors and infrastructure providers who host, secure, and operate the Service on our behalf, including BytePlus (Seedance) for generation and appearance verification, Alibaba Cloud (Qwen-Image), Google (Gemini) and Mistral for still-frame generation of confirmed persons, fal.ai for still-frame generation (Gemini Image / Nano Banana) and scene sound generation, and Amazon Web Services (Amazon Rekognition) for moderation;
• Payment processors — Stripe for card payments and NOWPayments for cryptocurrency — to process your purchases. Your full card details are provided directly to and processed by the payment processor; we do not store them. All purchases are final and non-refundable except where a refund is required by applicable law (see our Terms of Use);
• Legal authorities, where required by law, court order, or to report prohibited content;
• Rights holders, where necessary to handle likeness, copyright, or takedown complaints.

Each processor is bound by contractual obligations to protect your data and to use it only for the purposes we specify.

8. Your Rights

Depending on your jurisdiction, you may have the right to request access to, correction of, deletion of, or export of your personal data, and to withdraw consent to biometric processing. To exercise these rights, contact us at support@actoria.ai. We may need to verify your identity before acting, and we will respond within the time required by applicable law and in any event within 45 days.

9. Data Retention

We retain personal data only as long as necessary to provide the Service and to satisfy fraud-prevention, legal-compliance, and dispute-resolution obligations. Source images may be deleted after generation unless retention is required for safety, legal, or abuse-investigation purposes.

10. Data Security

We use encryption, layered access controls, monitoring, and periodic audits to protect your data. No system is completely secure, and you acknowledge that you provide information at your own risk.

11. International Transfers

Your information may be processed outside your country of residence, including in Hong Kong and in jurisdictions where our processors operate. Where required, we apply appropriate safeguards such as Standard Contractual Clauses.

12. Data Breach Response

In the event of a data breach affecting your personal data, we will notify affected users and the relevant authorities as required by applicable law.

13. Children

The Service is intended solely for users aged 18 and over. We do not knowingly collect data from minors, and any account found to belong to a minor will be deleted. See Section 5 for our zero-tolerance policy on child content.

14. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
